TCGPilot Terms of Service

These Terms of Service ("Terms") govern your access to and use of TCGPilot (the "Service"), a software platform designed to help trading card sellers manage collections and create marketplace-ready listings. By accessing or using TCGPilot, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old to use TCGPilot. By using the Service, you represent and warrant that you are legally able to enter into this agreement.

2. Account Registration

To use TCGPilot, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account.

3. Description of the Service

TCGPilot provides tools to:

• Import trading card lists (e.g., TCGPlayer lists)
• Track purchased trading card collections
• Upload and manage card images
• Generate and export marketplace listing data
• View market pricing data from third-party sources

TCGPilot does not act as a marketplace, payment processor, escrow service, or broker. We do not buy, sell, or authenticate trading cards.

4. Third-Party Services

TCGPilot may integrate with third-party services, including but not limited to marketplaces and pricing data providers (such as TCGPlayer). We do not control and are not responsible for third-party services, their availability, accuracy, or policies.

Your use of third-party services is subject to their respective terms and conditions.

5. Free Trial

TCGPilot may offer a free trial with limited features or usage, including but not limited to limits on the number of listings, duration, or supported features. Trial limits may change at any time.

We reserve the right to suspend or terminate trial access if we detect abuse, misuse, or attempts to circumvent trial limitations.

6. Subscription & Fees

TCGPilot is offered as a subscription-based service. Pricing, billing cycles, and features are described on our website.

TCGPilot charges no commissions on sales made using listings generated by the Service.

Subscription fees are non-refundable except as required by law.

We may modify pricing or plans with reasonable notice.

7. User Content

You retain ownership of all data, images, and content you upload to TCGPilot ("User Content"). By using the Service, you grant TCGPilot a limited, non-exclusive license to host, process, and display User Content solely to operate and improve the Service.

You are responsible for ensuring you have the right to upload and use any User Content.

8. License to Use the Service

Subject to these Terms and your active subscription, TCGPilot grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business operations.

This license does not transfer ownership of the Service or any intellectual property. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent usage limits, security features, or trial restrictions
• Resell, sublicense, or make the Service available to third parties
• Mirror or reproduce the Service on any other server or platform

Any rights not expressly granted are reserved by TCGPilot.

9. Data Accuracy and Seller Responsibility

You are solely responsible for the accuracy, completeness, and legality of all data, listings, images, pricing, and inventory information you upload or generate using TCGPilot.

TCGPilot provides tools to assist with pricing, listing creation, and inventory management, including data from third-party sources. However, TCGPilot does not guarantee the accuracy, completeness, or marketplace acceptance of any listings or pricing data.

You acknowledge that all pricing decisions, listing content, card condition assessments, and business outcomes remain your responsibility.

10. Prohibited Use

You agree not to:

• Use the Service for unlawful purposes
• Attempt to reverse engineer or exploit the Service
• Circumvent usage limits or trial restrictions
• Upload malicious code or harmful content
• Misrepresent card authenticity, condition, or ownership

We reserve the right to suspend or terminate accounts that violate these Terms.

11. Intellectual Property

TCGPilot and all related software, branding, and content (excluding User Content) are the property of TCGPilot and are protected by intellectual property laws.

You may not copy, modify, or distribute any part of the Service without our written permission.

12. Disclaimer of Warranties

TCGPilot is provided "as is" and "as available." We make no warranties regarding the accuracy of pricing data, marketplace acceptance of listings, or uninterrupted availability of the Service.

Use of the Service is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, TCGPilot shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, sales, data, or business opportunities.

Our total liability for any claim related to the Service shall not exceed the amount you paid to TCGPilot in the twelve (12) months preceding the claim.

14. Termination

You may stop using TCGPilot at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service.

Upon termination, your access to the Service and any stored data may be limited or deleted in accordance with our data retention policies.

15. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TCGPilot operates, without regard to conflict of law principles.
